Terms of Service
Effective 1 July 2024. These Terms apply to all AI Enabled websites and products unless a product has its own supplementary terms.
Acceptance
By accessing or using any AI Enabled website or product, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
Services
AI Enabled provides software products including ClinDraft and Mental Health Professionals. Each product may have its own supplementary terms in addition to these general terms. Features and pricing may change at any time with reasonable notice.
Accounts and access
Where a product requires an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us promptly if you suspect unauthorised access. Accounts must not be shared or transferred without our written consent.
Acceptable use
You agree not to:
- Use our services for any unlawful purpose or in violation of applicable law
- Attempt to gain unauthorised access to any system or data
- Reverse-engineer, decompile, or disassemble any part of our software
- Use our services in a way that damages, disables, or impairs them
- Transmit malicious code or interfere with service integrity
Intellectual property
All content, software, trademarks, and other materials made available through our services are owned by or licensed to AI Enabled. Nothing in these Terms grants you any right to use our intellectual property other than as necessary to use our services as intended.
You retain ownership of content you create and store using our products. By using our services, you grant us a limited, non-exclusive licence to process your content solely for the purpose of providing the service to you.
Limitation of liability
To the maximum extent permitted by Australian law, AI Enabled is not liable for any indirect, incidental, special, or consequential loss arising from your use of our services, including loss of data or business interruption.
Our total liability for any claim under these Terms is limited to the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater. Nothing in these Terms limits liability that cannot be excluded under the Australian Consumer Law.
Governing law
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising under these Terms.
Changes to these Terms
We may update these Terms from time to time. We will notify active users of material changes by email or in-product notice at least 14 days before they take effect. Continued use of our services after that date constitutes acceptance of the updated Terms.
